General Terms and Conditions of Purchase

These General Terms and Conditions of Purchase govern the use of the chocolateamatller.com website (hereinafter ‘the website’) owned by Chocolates Simón Coll, S.A. (hereinafter ‘Simón Coll’). Chocolates Simón Coll, S.A. is a public limited liability company with registered business address at Calle Sant Pere, 37 de Sant Sadurní d’Anoia, Spain, and holder of Spanish Tax Identity No. A-08720781, registered in the Mercantile Registry of Barcelona, on sheet 52473, on Page 119, in volume 4769, in Book 4090, in Section 2, Inscription 1, one of whose trade names is Simón Coll. By using the services offered by the Simón Coll online store, users are consenting to be bound by the General Terms and Conditions of Purchase corresponding to the version published by Simón Coll when the purchase order is placed. It is therefore advisable for customers to read these General Terms and Conditions before making a purchase.

1. Scope of the agreement

These General Terms and Conditions of Purchase are applicable to the online sale of all Simón Coll products to consumers and which may be delivered in Spain (except the Canary Islands, Ceuta and Melilla). Simón Coll hereby informs you that its website is for people aged 18 and over only. Simón Coll reserves the right to cancel a user’s access account if it detects fraudulent, speculative acts or acts in bad faith in the use of this service. Equally, Simón Coll reserves the right to cancel a user’s access account if it keeps negative or outstanding balance.

2. Prices and products

The applicable prices are those quoted on the website at the time the order is placed. The prices are displayed for each product and are inclusive of VAT (Value Added Tax). Customers are informed of the breakdown of the shipping costs when the order is placed. The prices on the website are in euros. Those prices, unless stated otherwise, do not include shipping costs, shipping insurance or any other additional service and annex to the product.
On the assumption of any possible mistakes on the prices displayed on the website, Simón Coll will get in touch with the client in order to solve the problem. The two possible solutions will be: accept the new price or proceed with the cancellation of the order. If Simón Coll is unable to get in touch with the user, the order will be canceled automatically. The display of the products and their characteristics and images will be stated on the products’ descriptions. Simón Coll reserves the right to make changes it considers necessary to the price of the products at any time and without warning; same as putting on hold or canceling them temporarily or for good.

3. Purchase process

Any purchase from the website will be subject to availability. The purchase process on the website is as follows:

3.1. Shopping Basket

All selected products will be added to the “Shopping basket”. The user must access that basket in order to start the purchase process. The user will be able to register or make the purchase as a guest. If the user chooses to get registered, they will need to introduce a username and password to access their account. All the information needed for the purchase will be shown in the account (payment and delivery details), which will have been already filled by the user when registering. Those details will be stored so each time the user makes a purchase they will auto-populate automatically. The details can be modified at any time. If the user chooses not to register, they will need to add those details during the purchase process with no need of creating an account.

3.2. Delivery options

Once the user has introduced the address for the delivery, the system will show the delivery costs (see details in part “5. Delivery: Types, Terms and Costs”) and a calendar with a delivery time, both of which can be modified and choose a different day and time (Monday to Thursday) within a month from the time of purchase. Saturday, Sundays and Bank Holidays there will be no deliveries.  For more information about delivery terms, please see section “5. Delivery: Methods, Terms and Costs”.

3.3. Payment

The user will choose the payment method and will accept the payment giving their consent. For more information, please see section “4. Payment methods”.

3.4. Acceptance

The user confirms the order and accepts the purchase of the selected products, the Terms and Conditions and the Privacy Policy.

3.5. Purchase order confirmation.

The user receives, on the email address stated in the register form or when ordering if the purchase is made as a guest, a communication specifying the details of the product, breakdown of the price, delivery method, purchase date, order number and expected delivery date. 4. Payment methods

Payment will be done at the end of the purchase process and it is mandatory for the order to be placed. In no case can the payment be done in arrears of the purchase. Payment on delivery, bank transfer or in-store payment are not permitted. Payments may be made by credit or debit card (Visa® or Mastercard®), or through PayPal. If the payment is done through credit card, the order amount will be blocked and will not be charged or added to your credit until the order has been shipped. If the payment is done through debit card the charge will be done at the moment of checkout. In all cases, the choice of payment method is made during the checkout process on the corresponding step. Customers must notify Simón Coll of any unauthorised charge or fraudulent use of their card used for purchases by email (amatllershop@chocolateamatller.com) or telephone (93.891.11.00), at the earliest opportunity so that Simón Coll may take the necessary actions. Payment service providers may also adopt anti-fraud measures that restrict certain types of operations or transactions. Simón Coll holds no responsibility for the application of this type of security policies.

5. Shipment and delivery

The purchases made through the Simón Coll website will never be sent to a post office box, they will always be delivered to addresses and to the person specified during the purchase process or they will have to be picked up in the preferred option from the shops dropdown menu.

Simón Coll holds no responsibility if the delivery is unsuccessful due to wrong or false information given by the user, or if the delivery can’t be finalised due to reasons that the delivery company can’t control, such as the absence of addressee.

Simón Coll holds no responsibility on delays of delivery due to problems within the delivery company, such as bad weather, strikes or holidays.

The delivery time must be estimated within 48 hours, depending on the day and time of confirmation. The delivery will take place only Tuesday to Friday, holidays excluded. For more detail:

  • Orders made from Monday to Thursday before 12:00 will be delivered within 48h.
  • Orders made from Monday to Wednesday after 12:00 will be delivered in 48-72h.
  • Orders made on Thursdays after 12:00, Fridays, Saturdays or Sundays will be delivered during the following Wednesday.
  • It is possible to change the delivery date for another one within the days following the proposed one for a month after the purchase, except for Fridays, Saturdays, Sundays and Bank holidays.
  • During Christmas, Simón Coll can not ensure the delivery in 48-72 hours due to a possible overflow of the delivery company.
  • Delivery to the Balearic Islands will be within 48-72 hours, Bank holidays not included.
  • Delivery is not available for the Canary Islands, Ceuta and Melilla.

Delivery terms are the same for the orders to be picked up from the shop.

Shipping costs are 8€ for Spain (Peninsula), except for the Balearic Islands, with a shipping cost of 14€. Between the 15th of April and the 15th of October, due to weather conditions, all orders will have an additional cost of 4€ to cover for the special delivery conditions needed to preserve the products in their optimal state. Hence, the shipping cost for the Spanish Peninsula will be 12€ and for the Balearic Islands will be 18€. Delivery terms will be the same throughout the year. There will be no additional shipping costs for the orders to be picked up from the shop.

In the case of unsuccessful delivery because the person is absent, the shipping company will try to contact the client by phone or will leave a notification for the client to get in touch with the shipping company). That way a second delivery will try to be arranged. Simón Coll has put in place the delivery method and logistics to ensure the best possible product conditions, that’s why it is very important to receive the product on a first delivery attempt (24h). If that’s not the case, Simón Coll holds no responsibility for the state of the product if the delivery took place two days after the agreed time, hence the client can not claim the purchase price back.

6. Order tracking

The user will receive an order confirmation email, the order number and the expected delivery date. The user will be able to track their order from the website’s “My Account” section. In the “Pending Orders” section, there will be the real-time state of the order. It could be “Processing”, which would mean is still being prepared and not delivered yet to the shipping company, or it could be “Completed”, once it’s been delivered to the shipping company. From that point, it will be them who will get in touch with the client and share a tracking number and delivery date.

In the “Order history” section, the user will see a list of previous orders made.

7. Product availability

In the event of any supply shortage or the stock of a product running out, customers will be immediately informed and they will have the choice of a refund for the amount of the products affected or allow Simón Coll to dispatch the products once they are available again. If a refund needs to take place, Simón Coll shall refund the customer the corresponding amount within 30 calendar days since the date it was informed of the cancellation request. The refund will be made via the same method used for payment. If the client chooses to wait for the products to be available, Simón Coll will take care of the shipping costs.

8. Returns policy

Simón Coll does not accept exchanges or returns because of the product perishable nature. In case of any complaints or anomalies with the product, the customer should get in touch immediately through amatllershop@chocolateamatller.com or, alternatively, fill the correct contact form.

Simón Coll will accept free of charge cancellations for orders cancelled after being prepared but not issued. For cancellations, clients should get in touch through  amatllershop@chocolateamatller.com making sure to state the delivery date scheduled, the username and the order number, or, alternatively, fill the correct contact form.
